BOOKISSA TERMS OF USE

 
1. Introduction
 

These Terms of Use (“Terms”) govern access to and use of www.bookissa.com and all related websites, subdomains, subdirectories, mobile websites, and mobile applications owned or operated by Bookissa (collectively, the “Site”).

Bookissa is a company registered in Malta under registration number N99/2014, with its registered office at Triq il-Bacir il-Gdid, Paola, PLA1501, Malta. VAT registration number: MT20072003.

By accessing or using the Site, you confirm that you have read, understood, and agree to be legally bound by these Terms.

These Terms apply solely to your use of the Site. They do not govern third-party goods or services made available for booking or purchase through the Site. Online ordering and booking services, including payments, vouchers, and reservations (the “Bookissa Services”), are provided under separate Terms of Service. Services delivered by third-party providers (including selected treatments) (“Partner Services”) are fulfilled by such partners and remain their responsibility.

Bookissa may amend these Terms at any time by publishing an updated version on the Site. Continued use following publication constitutes acceptance of the revised Terms. Subject to compliance with these Terms, Bookissa grants you a personal, limited, non-exclusive, and non-transferable licence to access and use the Site.

3. Privacy
 

Use of the Site is also subject to Bookissa’s Privacy Policy, which forms an integral part of these Terms.

While reasonable technical and organisational measures are implemented to safeguard personal data, transmission of information via the internet is not entirely secure. Bookissa cannot guarantee the security of data transmitted to the Site, including encrypted transmissions. Any transmission is undertaken at your own risk.


4. Access to the Site

You are responsible for ensuring that your device and software meet the technical requirements necessary to access and use the Site.

All registration information provided must be accurate and complete. Any login credentials (including usernames and passwords) must be treated as confidential. You are responsible for all activities conducted under your account and must promptly notify Bookissa of any unauthorised access or security breach.

Bookissa reserves the right to suspend or disable any account where there is a breach of these Terms or where registration information proves inaccurate or misleading.


5. Age Requirements

You must have reached the age of majority in your jurisdiction to use the Bookissa Platform.

Where local laws impose age-related contractual limitations, you must comply with those requirements. If you are under the age of majority, you may only use the Bookissa Services with the involvement and consent of a parent or legal guardian.

Parents or legal guardians who permit a minor to use the Services accept responsibility for that minor’s activity.


6. Accounts and Security

An account is not required to browse the Site but may be necessary to access certain functionalities.

Each individual may maintain only one account. Accounts are personal, non-transferable, and may not be sold, shared (except as expressly permitted for family accounts), or assigned.

Bookissa may immediately terminate or suspend accounts where there is a breach of these Terms, including but not limited to:

  • Permitting unauthorised third-party access;

  • Fraudulent conduct or misrepresentation.

Upon termination, Bookissa may cancel any pending bookings, credits, or unredeemed vouchers and may restrict future account creation.

Bookissa reserves the right to pursue legal remedies and to notify competent authorities where unlawful conduct is suspected.


7. Permitted Use

Unless you are an authorised Partner, the Site may be used solely for personal, non-commercial purposes and strictly in accordance with these Terms.

You may:

  • View content on-screen;

  • Print individual pages;

  • Store limited extracts electronically for personal use.

Additional conditions may apply to specific features and will be displayed where relevant.


8. User Obligations

By using the Site, you agree that you shall:

  • Use only authorised access methods and compatible devices;

  • Comply with all applicable laws and regulations, including EU and local legislation;

  • Use the Site responsibly and refrain from conduct that could harm Bookissa’s reputation;

  • Maintain confidentiality of account credentials;

  • Provide proof of identity upon reasonable request;

  • Use only authorised internet connections;

  • Bear any SMS or messaging charges incurred;

  • Refrain from commercial resale unless authorised.

Bookissa may terminate access immediately upon non-compliance.


9. Prohibited Conduct

You shall not:

  • Systematically extract or scrape content;

  • Interfere with security features or infrastructure;

  • Frame, mirror, or create unauthorised links to the Site;

  • Reverse engineer or develop competing services based on the Site;

  • Deploy automated extraction tools (bots, spiders, crawlers);

  • Commercially exploit, sublicense, or distribute the Site;

  • Modify or create derivative works;

  • Send spam or unlawful communications;

  • Upload malicious code;

  • Attempt unauthorised access.

Violations may result in immediate termination and legal action.


10. User Content

The Site may permit submission of user-generated content (“User Submissions”).

You remain solely responsible for your submissions. Bookissa does not endorse user-generated content.

User Submissions must not:

  • Infringe intellectual property or privacy rights;

  • Be defamatory, unlawful, discriminatory, obscene, misleading, or harmful;

  • Contain unsolicited marketing or undisclosed sponsored content;

  • Include malicious code.

By submitting content, you grant Bookissa a perpetual, irrevocable, worldwide, royalty-free, sublicensable licence to use, reproduce, modify, distribute, and display such content in any media. You waive any moral rights to the extent permitted by law.

11. Intellectual Property

All intellectual property rights in the Site and Bookissa Services, including text, graphics, software, trademarks, and logos, are owned by Bookissa or its licensors.

These Terms do not transfer ownership rights. No licence is granted except as expressly stated.

Where permitted copies are made, all proprietary notices must remain intact.


12. Content Accuracy and Availability

The Site is provided on an “as available” and “as is” basis.

Bookissa does not warrant uninterrupted, error-free operation. Access may be modified, suspended, or withdrawn at any time without notice.

Information provided (excluding user-generated content) is not intended as professional advice and should not be relied upon without independent verification.

The Site may contain links to third-party websites. Such links are provided for convenience only. Bookissa does not control or endorse third-party content and accepts no responsibility for their availability or accuracy.


14. Disclaimers and Limitation

To the fullest extent permitted under applicable EU law, Bookissa excludes all implied warranties regarding accuracy, completeness, and fitness for purpose.

Nothing in these Terms excludes liability where such exclusion is prohibited by law (including liability for death or personal injury caused by negligence or for fraud).


15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with English law.

Any dispute arising from these Terms shall first be addressed through good faith negotiations. If unresolved within thirty (30) days, the parties may refer the matter to mediation before pursuing available legal remedies.

Nothing in these Terms restricts mandatory consumer protection rights applicable under EU law.


16. Geographic Scope

The Site is administered from Malta. Access from other jurisdictions is undertaken at your own initiative and subject to compliance with applicable local laws.

Certain services or features may not be available in all regions.
